Terms of Service.

If you're reading this, you may be in the worst stretch of your marriage. The legal language below exists to protect both of us so the work we do together has a clear foundation. Before any of it: we're glad you found us. We take this work seriously. Now, here are the terms.

Read This First

Three things matter most before you agree:

1. We are coaches, not therapists. Marriage Triage provides coaching and education, not therapy, medical care, or legal advice. If you are in crisis, considering self-harm, or experiencing domestic violence, contact licensed professionals or emergency services immediately. The National Domestic Violence Hotline is 1-800-799-7233. The 988 Suicide and Crisis Lifeline is 988.
2. We do not guarantee outcomes. Marriage outcomes depend on many factors we do not control, including the actions of your spouse. We provide frameworks, structure, and direct coaching. What happens in your marriage is shaped by both of you.
3. We offer a 7-day refund window on the program. If you enroll in the Resuscitation Protocol and decide within 7 days (or before your first coaching call, whichever comes first) that the program isn't right for you, you can request a full refund. See Section 4 for full details.

1. Who We Are and What We Are Not

Marriage Triage is operated by Sarber Consulting Inc. ("Marriage Triage," "we," "us," "our"). We provide coaching, education, and structured curriculum focused on marital dynamics.

We are not licensed therapists, counselors, psychologists, psychiatrists, social workers, marriage and family therapists (MFTs), or medical professionals. We do not provide mental health treatment, medical diagnosis, medical advice, legal advice, or financial advice. Nothing in these Terms or in our programs constitutes mental health advice or treatment.

If you are experiencing a mental health crisis, suicidal thoughts, domestic violence, or any situation requiring professional medical or legal intervention, contact a licensed professional or emergency services immediately:

Marriage Triage is not a substitute for therapy, medical care, or legal counsel.

Our coaching is intended for adults (18 years or older) currently in a committed marital relationship who are seeking education and structured guidance on relational dynamics.

We may use AI tools to support content development, scheduling, and operational tasks. All coaching itself is conducted by human coaches.

2. Services Offered

We currently offer:

(a) Emergency Audit Consultation — a complimentary coaching call with Tyler Sarber, offered at no cost and scheduled subject to availability. Booking is subject to a brief qualification questionnaire.

(b) The Resuscitation Protocol — our 12-week, all-virtual coaching program designed for men navigating acute marriage crises. The program is delivered entirely online and includes no in-person sessions or events. The program currently includes weekly one-on-one coaching sessions conducted via video call, access to all program modules and materials, and between-session email support as defined in Section 6. Specific program components, schedule, and access details are described at the point of enrollment and may evolve over time. Material changes during an active enrollment will be communicated in writing.

(c) Free educational content — including the First Aid Instructions PDF, social media content, email content, and other materials provided at no cost.

We reserve the right to modify, discontinue, or change pricing on any service with reasonable notice. Pricing changes do not retroactively affect services already paid for.

3. Booking and Payment

All payments are processed through third-party payment processors (Stripe, Calendly, or others). By providing payment information, you authorize us to charge the agreed-upon amount.

The Emergency Audit Consultation is currently provided at no cost. Resuscitation Protocol fees are paid prior to program access being granted, either in full or via approved payment plan.

The total program investment for the Resuscitation Protocol is offered as follows based on the selected payment option:

Program access is granted upon payment confirmation (or first installment confirmation for payment plans) and delivery of the welcome email containing curriculum access details.

If a payment plan installment fails or is reversed, access to the program may be suspended until payment is resolved. If an account remains delinquent for more than seven (7) days past the due date, we reserve the right to terminate the Agreement and retain all payments received. Any remaining balance is owed in full upon default.

You are responsible for all applicable taxes, currency conversion fees, and bank charges associated with your payment.

By submitting payment, you agree that payment disputes must be resolved through the dispute resolution process described in Section 13. You expressly waive the right to initiate a chargeback for any services already delivered under these Terms.

4. Refund Policy

Emergency Audit Consultations

The Emergency Audit Consultation is currently provided free of charge. Because no fee is collected, no refund applies. If you are unable to attend a scheduled call, we ask that you cancel or reschedule in advance as a courtesy, so the slot can be offered to someone else who needs it.

The Resuscitation Protocol

(a) 7-Day Confidence Period: You may request a full refund of program fees within seven (7) days of enrollment OR before your first coaching call, whichever occurs first. To exercise this right, you must submit a written request to contact@marriagetriage.com within this window.

(b) After the 7-Day Confidence Period (or after your first coaching call, whichever comes first), all Resuscitation Protocol fees are non-refundable for the remainder of the 12-week enrollment.

(c) Statutory Cancellation Right: Under California law, you have the right to cancel this Agreement within three (3) business days of signing and receive a full refund of any amounts paid, provided that program materials have not yet been delivered and no coaching sessions have been conducted.

(d) Enrollment in the Resuscitation Protocol is for the full 12-week duration. Choosing not to attend remaining sessions does not entitle you to a refund.

(e) Sessions missed by you without at least 24 hours advance notice are forfeited and will not be rescheduled. We will make reasonable effort to reschedule sessions missed due to our unavailability. Missed sessions, regardless of cause, do not extend the 12-week program term.

(f) Coach Unavailability: If Marriage Triage is unable to complete program delivery due to illness, emergency, or other circumstances beyond our control, you will receive a prorated credit toward future services equivalent to the value of undelivered sessions.

5. No Guarantees

We do not guarantee any specific outcome, including but not limited to: saving your marriage, preventing separation or divorce, changing your spouse's behavior, restoring intimacy, improving communication, or any other relational outcome.

Marriage outcomes depend on many factors outside our control, including the actions of both spouses, the underlying circumstances of the relationship, mental health, addiction, abuse, infidelity, finances, and personal choices. Marriage Triage provides frameworks, education, and coaching; we do not control whether or how you apply what you learn, nor do we control your spouse.

You acknowledge that you have made an informed choice to engage Marriage Triage's coaching services rather than, or in addition to, licensed therapeutic services, and you accept full responsibility for that choice.

Testimonials, case studies, and examples shared in our marketing materials reflect individual experiences and are not promises of similar results.

6. Crisis Protocol and Email Support

Crisis Protocol: In the event you present with a mental health crisis, suicidal ideation, or intent to harm self or others, we will refer you to appropriate licensed mental health resources and may suspend coaching sessions until you have engaged with appropriate professional support. Coaching is not a substitute for emergency mental health services.

Between-Session Email Support: Between-session email support is limited to brief clarifying questions related to program content. We will respond within 48 business hours, defined as Monday through Friday, 9:00 AM to 5:00 PM Pacific Time, excluding federal holidays. This support does not constitute additional coaching sessions.

7. Your Responsibilities

By using our services, you agree to:

(a) Provide accurate information during booking, enrollment, and coaching sessions.

(b) Show up to scheduled calls on time and in a setting that allows you to focus.

(c) Engage honestly with the curriculum and coaching. Marriage Triage will provide curriculum, assignments, and structure. Your engagement with the work is your responsibility. The effectiveness of coaching depends substantially on your active participation.

(d) Treat Marriage Triage staff, coaches, and any community members with respect. We reserve the right to terminate services without refund for harassment, abuse, threats, or any behavior we determine to be in bad faith.

(e) Not record, copy, distribute, or republish any of our coaching calls, curriculum materials, slide decks, written content, or community discussions by any means — including audio, video, screen capture, transcription, or note-taking for distribution — without our express written permission.

(f) Not use our services in connection with any unlawful purpose.

(g) Not represent yourself as a Marriage Triage coach, affiliate, or partner unless we have agreed to such a relationship in writing.

8. Intellectual Property

All content provided by Marriage Triage, including but not limited to the Resuscitation Protocol curriculum, written materials, video content, audio content, frameworks (including the Six Categories, the Ledger, the Verdict, the DRAIN behaviors, the Source and Mirror dynamic, and all related concepts), trade names, logos, and visual designs, is the exclusive property of Sarber Consulting Inc. and is protected by United States and international copyright, trademark, and intellectual property laws.

All coaching methodologies, frameworks, materials, and content provided through the program remain the sole intellectual property of Marriage Triage, regardless of any client input, discussion, or collaboration during coaching sessions.

You are granted a limited, non-transferable, non-exclusive license to access and use our content for your personal, non-commercial use only. You may not:

Violation of this section may result in immediate termination of services without refund and may subject you to legal action.

9. Confidentiality

We treat coaching conversations as private. We will not publicly disclose your identity, identifying details, or the specifics of your situation without your express permission.

However, because we are coaches and not licensed therapists or attorneys, our conversations do not carry the same legal privilege protections that those professions provide. Specifically:

(a) Coaching conversations are not legally privileged in the way that conversations with a licensed therapist or attorney would be. This means that, unlike licensed therapy, our communications could potentially be subpoenaed in legal proceedings, including divorce or custody cases. We strongly recommend that you consult with your attorney if you have concerns about this distinction.

(b) We may use anonymized examples and patterns from coaching conversations in our educational content and marketing, with all identifying details removed.

(c) We may disclose information if required by law, court order, or to protect the safety of any person.

(d) Where there is suspected abuse or neglect of a minor or vulnerable adult, we may disclose as required by California law.

If at any point we become aware of imminent risk of harm to you or another person, we may take action we believe is necessary, including contacting emergency services.

Group Sessions: If you participate in group sessions or community forums (e.g., Skool), you acknowledge that information shared in group settings cannot be guaranteed as confidential by Marriage Triage, as we cannot control disclosures made by other participants.

10. Use of Testimonials and Content

From time to time, we may request to use anonymized or de-identified aspects of your experience for educational content, marketing, or case studies. We will always obtain your written consent before using any information that could identify you.

If you voluntarily provide a testimonial, review, or public endorsement, you grant Marriage Triage a non-exclusive, royalty-free, perpetual license to use that content across our marketing channels, including but not limited to social media, website, and promotional materials.

11. Privacy

Information you provide to us (name, email, phone, payment information, content of coaching conversations) is collected and processed in accordance with applicable California law, including the California Consumer Privacy Act (CCPA). We do not sell your personal information to third parties. Clients who wish to exercise their rights under the CCPA may contact contact@marriagetriage.com.

By using our services, you consent to the collection and use of your information as described here.

12. Limitation of Liability

To the maximum extent permitted by law:

(a) Marriage Triage, its owners, officers, employees, contractors, and coaches are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of our services, including but not limited to damages for emotional distress, loss of relationships, loss of income, or any decision you make based on our coaching.

(b) Our total liability for any claim arising out of or in connection with our services shall not exceed the total amount you paid us in the twelve (12) months preceding the claim, except in cases of gross negligence or willful misconduct.

(c) Marriage Triage is not responsible for the actions, statements, or decisions of your spouse, family members, or any third party.

You agree that you are making your own decisions about your marriage and life, and Marriage Triage is not responsible for the outcomes of those decisions.

13. Indemnification

You agree to indemnify and hold harmless Marriage Triage, Sarber Consulting Inc., its owners, and all associated parties from any claims, damages, losses, liabilities, or expenses (including reasonable attorney fees) arising from:

We may terminate your access to our services at any time, with or without notice, if:

In the case of termination for cause, no refund will be provided.

You may stop using our services at any time. Refund eligibility is governed by Section 4.

15. Dispute Resolution and Binding Arbitration

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Before initiating any formal legal action, both parties agree to attempt to resolve any dispute in good faith through direct written communication for a period of at least thirty (30) days.

IMPORTANT — BINDING ARBITRATION AND WAIVER OF JURY TRIAL:

 

Any dispute arising out of or relating to these Terms or our services that is not resolved through informal negotiation shall be resolved exclusively through binding arbitration in Riverside County, California, in accordance with the Consumer Arbitration Rules of the American Arbitration Association (AAA). By agreeing to these Terms, you acknowledge that you have read and understand this arbitration provision and that it waives your right to a jury trial and your right to participate in a class action or class-wide arbitration.

16. Communication and Follow-Up

By booking a session or enrolling in a program, you consent to receiving follow-up communications from Marriage Triage via email, including session summaries, check-in messages, and program-related information. These communications are generated to support your coaching experience and may include AI-assisted personalization.

You may opt out of non-essential communications at any time by contacting contact@marriagetriage.com. Please note that opting out of program-related communications during an active enrollment may affect your coaching experience.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of our services after changes constitutes acceptance of the revised Terms.

For material changes that affect your rights or obligations under an active engagement (such as an enrolled Resuscitation Protocol program), we will notify you by email.

19. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, along with any other policies or agreements referenced herein (including any specific Coaching Services Agreement signed at the time of program enrollment), constitute the entire agreement between you and Marriage Triage regarding your use of our services.
